Background

* Foreign-related IP disputes over software occur frequently, and the independent innovation of China¡¯s IT industry faces challenges
¡ª¡ªOn Jan. 24, 2003, Cisco launched a lawsuit against Huawei for illegal copying of its application software; in 2004, Sun Microsystems reached reconciliation with Kodak on a Java software patent litigation; in Feb. 2007, Silicon Image accused Analogix Semiconductor of peculating its commercial secrets and violating the copyright of its semiconductor configuration software; and in Feb. 2008, EU issued an anti-trust penalty of EUR 900 million to Microsoft.
Software IPR issue becomes increasingly apparent along with the development of information technology. Along with the rapid development of computer software industry, software industry accounts for an increasingly bigger share in national economy. Software has penetrated into all fields of national economy and daily life, and its importance has won extensive recognition. How to provide a more reasonable and effective legal protection system has become an inevitable problem to be solved by the legal community and the industry.

* Patent technology standardization trend becomes evident in Digital Era, and management system for intellectual property in standard requires regulation£¡
¡ª¡ªOn Mar. 26, 2008, Rambus finally won a key victory in a legal dispute with major memory chip manufacturers lasted for nearly ten years. A jury of San Jose District Court decided that since Rambus had provided patent licensing to other companies, it did not conduct monopoly. Finally, Rambus won the IP dispute aroused since Rambus asked for patent royalty from DRAM manufacturers after cheating Jedec to compile the DRAM standard.
Along with the enhancement of the status of standardization in trade, integrating IP into technical standard has become an important measure adopted by foreign high-tech enterprises to implement IP strategy. However, how to manage intellectual properties owned by various standard makers in standardization process will become an increasing hot topic for IT industry.

* Anti-trust Law has been issued, and many industries in China face reshuffling £¡
¡ª¡ªOn August 1, 2008, China¡¯s first Anti-trust Law took effect. From planning, drafting, passing and implementation, this ¡°economic constitution¡± of China for protecting fair competition has gone through 14 years.
Though there is still a long way to go to issue the implementation rules of the Anti-trust Law, it is undeniable that the law has brought opportunity and hope for domestic IT enterprises because the value of the Anti-trust Law lies on future-oriented incentive and guidance function. It will provide basical principals for Chinese enterprises to fight against those multinational companies pressing the development space of Chinese industries with market monopoly and technical monopoly. It also indicates that many industries in China will face reshuffling. We believe that the reform measures properly designed in the Anti-trust Law will display its profound significance as time goes by.

* Along with the issuance of National Intellectual Property Strategy Guidelines, the construction of China¡¯s intellectual property system enters into a strategic opportunity phase.
¡ª¡ªAt 10am on Jun. 13, 2008, the press conference for National Intellectual Property Strategy Guidelines was held by the State Council Information Office.
